DMCA (Digital Millennium Copyright Act) Notice & Takedown Policy

1. Introduction

BookSheet.site (“we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. This DMCA Notice and Takedown Policy outlines the procedures we follow in compliance with the Digital Millennium Copyright Act of 1998 (“DMCA”).

As an online service provider, we respond to valid infringement notices and take appropriate actions under the DMCA and other applicable intellectual property laws.

2. Reporting Copyright Infringement

A. Required Information for a Valid DMCA Notice:

  1. Physical or Electronic Signature: A signature (physical or electronic) of the copyright owner or a person authorized to act on their behalf.

  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.

  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit us to locate the material. Please provide specific URLs (web addresses) where the allegedly infringing content is hosted on BookSheet.site.

  4. Contact Information: Your contact information, including your address, telephone number, and an email address.

  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA.

A. Required Information for a Valid Counter-Notice:

  1. Your Signature: Your physical or electronic signature.

  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed/disabled.

  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Your Contact Information: Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which BookSheet.site may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

B. Submit Your Counter-Notice to Our Designated Agent (same as above).

Warning: Knowingly materially misrepresenting in a counter-notification that material was removed by mistake may result in liability for damages, including costs and attorneys’ fees.

4. Actions We May Take

Upon receipt of a valid and complete DMCA infringement notice, we will:

  1. Promptly remove or disable access to the allegedly infringing material.

  2. Notify the user (content provider) who posted the material that we have removed or disabled access to it.

  3. Provide the user with a copy of the DMCA notice.

  4. Terminate repeat infringers’ access to the Service in appropriate circumstances.

Upon receipt of a valid and complete counter-notice, we will:

  1. Promptly provide the original complainant with a copy of the counter-notice.

  2. Inform them that we may replace the removed material or cease disabling access to it in 10 business days.

  3. Replace the removed material or cease disabling access to it within 10 to 14 business days after receiving the counter-notice, unless our Designated Agent first receives notice from the original complainant that they have filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on our site.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
